Trademarks

Trademark registration and portfolio management sit at the core of O. Kayode & Co.’s practice. We advise domestic and international clients on filing strategy, prosecution before the Trademarks, Patents and Designs Registry in Abuja, and the maintenance and enforcement of registered rights across Nigeria.

For international brand owners, a critical point: Nigeria is not a member of ARIPO or OAPI. A trademark registration obtained through either regional system does not extend to Nigeria. A separate national application is required to obtain protection in the Nigerian market.

Our trademark work spans initial searches and clearance, application and prosecution, responding to official actions, oppositions and invalidations, portfolio audits, assignment and recordal of changes of ownership, and licensing advice. We manage portfolios covering dozens of classes across multiple sectors, with particular depth in pharmaceuticals and FMCG, consumer goods, technology, entertainment, and fashion.

Relevant legislation: Trademarks Act Cap T13 LFN 2004 (as applicable). Legal advice is tailored to the specific facts of each matter.
