Anti-Counterfeiting

Anti-counterfeiting and brand protection are at the core of O. Kayode & Co.’s practice. We understand that the value of brands lies in their ability to stand untainted, and the need to protect trademarks from unauthorised use and other forms of brand theft is a continuous operational requirement for the businesses we serve.

We have assisted and continue to assist clients with various enforcement matters in Nigeria and across sub-Saharan Africa. The firm manages enforcement portfolios for both domestic and international clients, and has successfully handled counterfeiting cases defending high-profile clients and internationally recognised brands.

Effective anti-counterfeiting in Nigeria typically involves coordinating across three layers. NAFDAC’s market surveillance and post-market monitoring operations provide regulatory authority to act against substandard and counterfeit medicines and regulated products. The Nigerian Customs Service IPR unit monitors border entry points for infringing imports. Where criminal conduct is established, prosecution through the Federal High Court may follow civil enforcement actions.

Navigating this model requires direct working relationships with officials at each agency, developed over years of practice.
