Advertising Law

Advertising in Nigeria is regulated primarily by the Advertising Regulatory Council of Nigeria (ARCON) under the Advertising Regulatory Council of Nigeria Act 2022, which replaced the earlier APCON framework and significantly expanded the scope and enforcement powers of the regulatory body.

Compliance with the ARCON regulatory framework is a legal requirement for all advertising and marketing communications directed at Nigerian audiences, whether produced domestically or internationally. The Act applies across all media, including digital platforms, influencer marketing, and social media advertising.

This is particularly relevant for international brands running multi-market advertising campaigns that touch the Nigerian market.

We advise on pre-publication clearance of advertising materials, on regulatory compliance for advertising in regulated sectors including pharmaceuticals and FMCG, and on disputes arising from advertising content.
