Trademarks Filing Requirements:
To file an application in Nigeria we need:
- Representation of the mark i.e. 20 bromide copies of the mark or device.
An electronic version of the mark in case of a device should be made available.
- Specification of goods in relation to which the trademark is used or upon which
the applicant intends to use the trademark (relevant classes) NISE Classification
of
goods 8th edition.
- The applicant's details: name, address and country of incorporation where appropriate.
- Signed Power of Attorney in our favour, no further legalisation/notarisation is necessary (copy enclosed).
- ** Note: Please note that the application will not proceed to examination, until
such a time as Trademark Official fees are paid.
- Service marks are currently not registrable in Nigeria
Trademarks Filing Procedure:
In the first instance once an availability search is conducted
and successful, the
application can be filed.
The trademark office proceeds to conduct a substantive examination of the application
and issues a report. Provided no objections are raised and no prior application exists,
the trademark shall be accepted and should proceed for publication in the trademark
journal for opposition purposes.
The period within which an opposition can be raised is two (2) months from the date of publication of the journal.
The registration shall fall due for renewal of seven (7) years after date of application
and
14 years subsequently afterwards.
